Ao acessar ou utilizar o 10Quant (a "Plataforma"), você concorda em ficar vinculado a estes Termos de Serviço ("Termos"). Se você não concorda com estes Termos, não poderá acessar ou utilizar a Plataforma.

Estes Termos constituem um acordo juridicamente vinculante entre você e o 10Quant. Reservamo-nos o direito de atualizar estes Termos a qualquer momento, e o seu uso continuado da Plataforma constitui a aceitação de quaisquer alterações.

O 10Quant oferece uma plataforma automatizada de pair trading para mercados de criptomoedas. Nossos serviços incluem execução automatizada de trades, monitoramento de desempenho, ferramentas de gerenciamento de risco e painéis analíticos.

Nossa Plataforma se conecta às exchanges de criptomoedas suportadas por meio de chaves API fornecidas por você. Todos os trades são executados na sua conta da exchange. O 10Quant não toma posse dos seus fundos em nenhum momento.

Você deve registrar uma conta para utilizar nossos serviços. Você é responsável por manter a confidencialidade das suas credenciais de conta e por todas as atividades que ocorrem em sua conta.

Você deve fornecer informações precisas e completas durante o registro. É obrigação sua atualizar suas informações prontamente caso ocorram alterações.

Você deve ter pelo menos 18 anos de idade e ser legalmente autorizado a utilizar serviços de negociação de criptomoedas em sua jurisdição.

You agree not to engage in any of the following prohibited activities: market manipulation, spoofing, wash trading, or any practice that could distort market prices or disadvantage other market participants.

You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform, its algorithms, or its underlying technology.

You may not use automated tools (bots, scrapers, spiders) to access the Platform for purposes other than those expressly permitted, or attempt to gain unauthorized access to any part of the Platform or its related systems.

You may not abuse the Platform's infrastructure, including excessive API calls, bandwidth consumption, or any activity that could degrade performance for other users.

You are solely responsible for the security of your API keys. You must use trade-only API key permissions and must not share your API keys with any third party. You acknowledge that any unauthorized use of your API keys is your responsibility.

O 10Quant atua como provedor de ferramentas e não oferece consultoria financeira personalizada, recomendações de investimento ou serviços de gestão de portfólio.

A negociação de criptomoedas envolve risco substancial, incluindo a possível perda de todo o seu investimento. Condições de mercado, falhas técnicas e mudanças regulatórias podem resultar em perdas financeiras significativas.

Você reconhece que leu e compreendeu nosso documento de Divulgação de Riscos e aceita os riscos associados ao uso de sistemas de trading automatizado.

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10Quant does not warrant that the Platform will be uninterrupted, timely, secure, or error-free. We do not guarantee the accuracy, completeness, or reliability of any trading data, analytics, or performance metrics displayed on the Platform.

You acknowledge that the Platform relies on third-party exchange APIs, network infrastructure, and market data feeds. 10Quant is not responsible for any losses resulting from exchange outages, API failures, data feed errors, or any other third-party service disruptions.

Na máxima extensão permitida por lei, o 10Quant não será responsável por quaisquer danos diretos, indiretos, incidentais, especiais ou consequenciais decorrentes do seu uso da Plataforma, incluindo, mas não se limitando a, perdas de trading, indisponibilidade do sistema ou violações de dados.

Nossa responsabilidade total para com você não excederá o total de taxas pagas por você ao 10Quant nos 12 meses anteriores à reclamação.

You agree to indemnify, defend, and hold harmless 10Quant, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

This indemnification obligation will survive the termination of your account and these Terms.

As taxas de assinatura são cobradas antecipadamente de acordo com o plano selecionado (mensal ou anual). Todos os pagamentos são processados por nossos parceiros de pagamento autorizados.

Aceitamos pagamentos em criptomoedas, incluindo BTC, ETH, USDT e USDC. Os preços são listados em USD e convertidos pela taxa de câmbio vigente no momento do pagamento.

Os reembolsos estão sujeitos à nossa garantia de devolução do dinheiro em 30 dias para novos assinantes. Após o período de garantia, o tempo de assinatura não utilizado não é reembolsável.

Todo o conteúdo, software, algoritmos e materiais na Plataforma são propriedade do 10Quant e são protegidos por leis de propriedade intelectual. Você não pode copiar, modificar, distribuir ou realizar engenharia reversa de qualquer parte da Plataforma.

O 10Quant concede a você uma licença limitada, não exclusiva e intransferível para utilizar a Plataforma para fins de trading pessoal e não comercial durante o período de assinatura ativa.

10Quant shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to: natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

This also includes exchange outages, API deprecations or failures, regulatory changes or government actions affecting cryptocurrency trading, network attacks (DDoS, hacking), blockchain forks or consensus failures, and pandemic or epidemic events.

If a force majeure event continues for more than 60 consecutive days, either party may terminate these Terms upon written notice.

Qualquer das partes pode rescindir este acordo a qualquer momento. Você pode cancelar sua assinatura através das configurações da sua conta. Após a rescisão, seu acesso à Plataforma cessará ao final do período de cobrança vigente.

Reservamo-nos o direito de suspender ou encerrar contas que violem estes Termos, pratiquem atividades fraudulentas ou representem risco para a Plataforma ou outros usuários.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration administered by a mutually agreed upon arbitration institution. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against 10Quant.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 10Quant is organized, without regard to its conflict of law provisions.

Exception: Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement: These Terms, together with our Privacy Policy and Risk Disclosure, constitute the entire agreement between you and 10Quant and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.

Podemos atualizar estes Termos periodicamente. Alterações significativas serão comunicadas por e-mail ou notificação na Plataforma com pelo menos 30 dias antes de entrarem em vigor. O uso continuado da Plataforma após as alterações entrarem em vigor constitui aceitação dos Termos revisados.
